DrGo M-lendar Terms and Conditions
1.
DrGo M-lendar provides people with cycles with information and insights about menstrual and reproductive health from menarche to menopause. By tracking the cyclic changes in your body help you to understand your unique pattern.
2.
DrGo M-lendar is a feature in the DrGo App. DrGo, DrGo App and DrGo M-lendar are operated by us, eSmartHealth Limited (“eSmartHealth”), a member of the HKT Group.
Personal Data

A User agrees that the use of M-lendar and any information provided by a User for using M-lendar in the DrGo App is on a voluntary basis and such information provided would be for providing you with the services under the M-lendar and all directly related purposes. If we request personal data from you that constitutes Personal Data (meaning Personal Data as defined under the Personal Data (Privacy) Ordinance), you may decline to provide the Personal Data but in that event certain services and functions under the M-lendar may not be provided to you.

Use of the M-lendar is subject to these Terms and Conditions and the applicable terms of DrGo, as well as the Personal Information Collection Statement of DrGo and the our Privacy Statement (available on DrGo website: www.drgo.com.hk and the DrGo App) which you have agreed to be bound to upon registration at DrGo. The said statement provides information on our policies in relation to the collection, retention, processing or handling of Personal Data by us during service provision of DrGo including the M-lendar.

A User has a right to withdraw the User’s consent to our use of the User’s data for direct marketing purpose (if given) at any time. A User is also entitled to access, correct or enquire about the User’s personal data being held by us. For any such request or for further details on the compliance with the Ordinance, please contact our Privacy Compliance Officer by letter to eSmartHealth Limited, GPO Box 9896, Hong Kong or by email to privacy@pccw.com.
Limitation of responsibility and liability

We shall not be liable to any person for any action, liability, cost, claim, loss, damage, proceeding, and/or expense (collectively, “Losses”) howsoever caused (regardless of the form of action) arising directly or indirectly from:
a) any access, use and/or inability to access, use the DrGo App, the M-lendar and any materials;
b) any person’s reliance on any data or information made available through the DrGo App and/or the M-lendar, which should first be independently verified;
c) any event(s) beyond our reasonable control;
d) any loss or corruption of any data, database or software; or
e) any use of or access to any other website or webpage linked to the DrGo App, even if we or our Groups’ officers or agents or employees may have been advised of, or otherwise might have anticipated, the possibility of the same;

Users are responsible for configuring their information technology, computer programs and platform in order to access the DrGo App, the M-lendar and any materials and use their own virus protection software.
8.
Users agree that any risk of misunderstanding, error, damage, expense or Losses resulting from the use of the DrGo App and/or the M-lendar is entirely at the Users’ own risk and we shall not be liable therefor.
9.
Any information presented in the DrGo App is in no way intended as a substitute for medical consultation. eSmartHealth and other members of the Groups disclaim any liability from and in connection with the DrGo App and the M-lendar.
General Provisions
10.
The interpretations of these Terms and Conditions and all other terms and conditions applicable to the M-lendar are at our sole discretion, which decisions shall be final, binding and conclusive.
11.
In the event of any dispute in connection with these Terms and Conditions or other terms and conditions applicable to the M-lendar, our decisions shall be final, binding and conclusive.
12.
In the event of any discrepancy between the English version and any translated version of these Terms and Conditions, the English language version shall prevail.
Calculation Algorithm
All the information and calculations in DrGo M-lendar are for reference only. The calculations are based on certain assumptions, including the data entered by the user. Actual dates may vary. DrGo shall not be liable for any discrepancy or representation of any data.
